Transition Update: Biden announces agency Review Teams

As anticipated in our most recent Transition “Next Steps” post from Monday, the Biden-Harris Transition team on Tuesday this week announced its Agency Review teams.  These are the groups assigned to interact with each Federal agency, take inventory of pending issues, such personnel and agency management, budget, and policy, and report back an assessment that will be used both for briefing incoming political appointees and developing policy approaches.  

 

Complicating the work of these Review Teams, the Trump Administration, through its administrator of General Services Administration (GSA), has refused, as of this writing, to recognize Vice President Biden and Senator Harris as the “President-elect” and “Vice-President-elect.”  Those terms are defined under the Presidential Transition Act of 1963 as “such persons as are the apparent successful candidates for the office of the President and Vice President, respectively, as ascertained by the Administrator following the general elections.”  Absent such a determination, the Biden Transition is denied access to agency career staffers, briefing materials, funding, office space, and other resources specified by Federal Law. 

 

The Biden Transition has signaled its intent to proceed despite this GSA position.
