Customs and Trade

OFW Law’s Customs & Trade attorneys have decades of experience representing clients in this complex and highly technical area in matters involving Customs and Border Protection (CBP), the International Trade Commission (ITC),  the International Trade Agency (ITA), and the World Trade Organization (WTO).

On the Customs side, we regularly provide advice and guidance on import-related issues such as tariff classification and valuation, country of origin, quota, intellectual property rights, and special tariff provisions, aiding our clients to stay compliant with U.S. laws while identifying opportunities for lawful duty savings.  Where disagreements arise with CBP, we vigorously represent our clients before the agency and have successfully resolved numerous enforcement proceedings, including detentions, seizures, and penalties; we have also successfully resolved liability for importer error many times via the prior disclosure process.  Our team has recouped substantial refunds for our clients via administrative protest and (where necessary) litigation at the Court of International Trade and Court of Appeals for the Federal Circuit.

Our attorneys are highly experienced in advising and representing both foreign exporters and U.S. importers on all aspects of compliance and enforcement in the forced labor and UFLPA area, including successfully obtaining the complete modification (lifting) of four major U.S. forced labor enforcement actions (WROs/Findings) to date.

On the trade side, OFW Law represents interested parties in investigations by the ITC and ITA under the antidumping and countervailing duty statutes, safeguard actions under Section 201 of the Tariff Act of 1930, and USTR enforcement proceedings under Section 301 of the Tariff Act of 1930.  We have deep experience in representing commercial interests on World Trade Organization matters and in all stages of WTO dispute settlement proceedings, as well as advising on Free Trade Agreement and international agreement negotiation, compliance, and dispute resolution.

While we primarily serve clients in the food, drug, agriculture, cosmetic, and medical device space, we have represented clients in many industries falling outside that sphere, including, for example, metals, machinery, apparel, footwear, furniture, textiles, and more.
